India: Strategy

This month’s Real Estate Updates cover key legislative and regulatory developments impacting apartment ownership, real estate project registrations and cooperative housing societies. The updates include the Karnataka Apartment (Ownership and Management) Bill, 2026, proposed changes to the framework governing apartment ownership and redevelopment, TNRERA’s extension of project registration timelines in view of the prevailing situation in West Asia, and the Maharashtra Government’s decision to lift the ban on allotment of state-owned land to cooperative housing societies.

It is worth being precise about what the Riyadh Design Law Treaty does and does not do. It does not harmonise the substantive law of what qualifies as a protectable design, nor does it create a single global design right. What it harmonises is procedure  the formalities an applicant must satisfy when seeking design protection in a member country. That may sound modest, but for businesses filing across multiple jurisdictions, procedural divergence is precisely where cost, delay and lost rights accumulate.

The updates examine the Supreme Court’s approach to environmental restrictions in the Taj Trapezium Zone, the continued responsibility of developers to honour contractual possession commitments despite regulatory extensions, the availability of specific performance where contracts provide for a refund, and the evolving insolvency jurisprudence strengthening protections available to homebuyers.
