WASHINGTON, D.C.—The Privacy + Security Forum is a can't-miss event for professionals in the cybersecurity field, and this year, Womble Carlyle's Allen O'Rourke and Marty Stern will be among the thought leaders sharing insights at the forum.

Stern will discuss "The FCC's Evolving View on Privacy and Data Security." FCC actions can implicate a broad range of companies. Its evolving approach to jurisdictional questions is of critical significance for the digital economy. This session examines this issue as well as new developments in the FCC's enforcement of privacy and data security claims. Stern also will address the FCC's emerging response to robocalling and spoofing caller IDs.

O'Rourke will take part in a panel discussion titled "The Emerging Law of Active Cyber Defense." Cybersecurity experts are continually developing new ways to protect computers and investigate breaches, vulnerabilities, and adversaries. "Active defense" techniques may include honey pots, web beacons, "dark web" research, rescue missions, and much more, including so-called "hacking back." But many techniques are clearly illegal or fraught with legal risk. This panel discusses legal frameworks for active cyber defense, especially the CFAA, and explores how the law could evolve in the future.

He will be joined in the panel discussion by US Department of Justice Special Counsel Leonard Bailey, Kroll Senior Director for Cyber Security and Investigations Devon Ackerman and AT&T Services Assistant Vice President & Senior Legal Counsel Jonathan Gannon.
