European Patent Convention

Any natural or legal person, or any body equivalent to a legal person can file an application to obtain a European patent by virtue of the law governing it.

The documents and other requirements are as follows:

  • Four copies of the patent specification and claims preferably drawn up in accordance with the European format.
  • Four sets of the drawings.
  • A certified copy of the basic application (to be filed within 16 months as of the priority date) when filing under the convention.

The contracting states as at January 1, 1992 are:

Austria (AT), Denmark (DK), Germany (DE), Greece (GR), Ireland (IE), Luxembourg (LU), Netherlands (NL), Spain (ES), Sweden (SE), Belgium (BE), France (FR), Great Britain (GB), Italy (IT), Monaco (M), Portugal (P), Switzerland with Liechtenstein (CH/LI).

Applicants may obtain protection in any or all of the contracting states by designating them at the time of filing the European patent application.

Where patents are granted as confirmation of U. K. patents, European patents (U. K.) designating the United Kingdom can be used to obtain protection in the following countries: Bermuda, Cyprus, Cayman Islands, the Falkland Islands, Guernsey, Jersey, Kenya, Singapore, Tanzania, Trinidad and Tobago and Uganda.n.
