Turkey: Dodd-Frank, Consumer Protection Act

In Application No. 2024/187 before the Constitutional Court, provisions of the Consumer Protection Law No. 6502 and the E-Commerce Law No. 6563 were challenged as unconstitutional in a non-pecuniary damages case concerning a defective product purchased online.

Under the phrase set out in Article 48(6)(d) of the LPC, operators of electronic commerce marketplaces acting as intermediary service providers were exempted from liability for the exercise of consumers’ alternative rights in respect of defective goods as regulated under Article 11 of the LPC — even where such operators collected payment on behalf of the seller or supplier.

TKHK m.48(6)(d)’deki ibare uyarınca, aracı hizmet sağlayıcı sıfatıyla faaliyet gösteren elektronik ticaret pazaryeri işleticileri, satıcı veya sağlayıcı adına bedel tahsil etmeleri halinde bile Kanun’un 11. maddesinde düzenlenen ayıplı mala ilişkin tüketici seçimlik haklarının kullanımından sorumlu tutulamamaktaydı. ETK m.9(1) ise aracı hizmet sağlayıcıları, diğer kanunlarda aksine hüküm bulunmadıkça, hizmet sağlayıcı tarafından sunulan içerik ile içeriğe konu mal veya hizmetle ilgili hukuka aykırı hususlardan genel olarak muaf kılmaktaydı.
