In news related to non-competition agreements, proposed
constitutional changes in Georgia could make it much easier to
enforce this type of agreement in that state. The Georgia
Legislature recently gave final approval to a constitutional
amendment to provide for judicial enforcement of certain
non-compete agreements, including those between franchisors and
franchisees, distributors and manufacturers, employers and
employees, lessors and lessees, partnerships and partners, sellers
and purchasers of a business, or two or more employers. Notably,
the legislature unanimously adopted the proposal.
Georgia voters will vote on the proposal on the statewide ballot
in November.
